The FA Community Shield On-Air Ticket Competition

McDonalds & LBC Community Shield Competition SPECIAL RULES (“Special Rules”)

1.         Rules: Please note that, in addition to these Special Rules, participants are bound by McDonald’s standard Ticket Promotion General Rules (the “General Rules”) which can be found at www.lbc.co.uk.

2.         Participants: The competition is only open to over 18’s only.

3.         Duration of Promotion:  The promotion will run on Saturday 24th July 2010 in Scores. The opening and closing times of the competition will be given out on air.

4.         Entry Criteria: Listeners will be asked a football related question and asked to text the answer to 84850. From all the correct entries received 10 winners will be selected at random.

5.         How to Submit your Entry: Listeners will be asked to text 84850 with the answer to the question.  No other method of entry will be accepted.

6.                  Prizes: The prize pool consists of 10 prizes each of a pair of tickets for the Community Shield match between Chelsea and Manchester United at Wembley on 8 August 2010.

7.         Prize Draw:  The redemption centre will attempt to contact the prize winners by telephone within 36 hours of the prize draw being made.

TICKET PROMOTION GENERAL RULES (“General Rules”)
    
1.    APPLICATION OF RULES

These General Rules apply to all ticket prize promotions relating to the 2010Community Shield match (each a “Promotion”) run by the Promoter in conjunction with McDonald’s. By participating in a Promotion, you are agreeing to be bound by the specific Promotion rules of the Promoter headed ‘Special Rules’ (the “Special Rules”) as well as these General Rules (together, the “Rules”). In the event of conflict between the Special Rules and the General Rules, the provisions of the Special Rules shall prevail.

All instructions, rules and conditions on any advertising or promotional materials (including notifications, acceptance forms, packaging and liability release forms) relating to this Promotion form part of the Rules although, in the event of conflict, the provisions of these General Rules and the Special Rules shall prevail over all such other instructions, rules and conditions.  Expressions which have been defined herein shall have the same meanings when used in such other instructions, rules and conditions wherever the context admits.

2.    PARTICIPANTS

Unless otherwise stated in the Special Rules, you must be: (i) aged 16 or over; and (ii) UK resident to participate in the Promotion (as defined in the Special Rules). The following are not eligible to participate: (i) Employees and immediate family members of employees of any of McDonald’s Restaurants Limited (“McDonald’s”), the Promoter, any company responsible for redemption of prizes/vouchers or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors, (ii) other persons assisting with this Promotion, (iii) any person not being an individual person, (iv) any syndicate or collection of persons acting in concert, (v) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.

3.    DURATION

Participation in the Promotion is scheduled to take place during the dates set out in the Special Rules. All dates are inclusive.  

4.    HOW TO ENTER

All entries must comply with the Entry Criteria set out in the Special Rules, which may include answering specific questions. Where entry is by a pre-printed form, any wording required must only use the pre-printed lines only. Entrants must also keep within any word limits set out in the Special Rules. Any additional wording will be disregarded.

For Entry Using a Pre-Printed Form or Form Printed From a Website: Entrants must (i) detach or print the form (as appropriate), (ii) comply with the Entry Criteria, (iii) ensure the form is signed by the entrant, and (iv) send the form to arrive no later than the closing date for receipt of entries by post enclosing the entry form in a properly stamped (-franking is not acceptable-) handwritten envelope addressed to the Promotion Address set out in the Special Rules.

For Entry by Sending an SMS: Entrants must (i) comply with the Entry Criteria, (ii) have access to a UK mobile phone, (iii) send your name and contact details in a SMS message (together with any answer to any questions, where applicable) to the number indicated. If using a mobile phone which is not your own, please remember to get the owner’s permission before entering. SMS messages will be charged at your standard network rate.

For Entry by Telephone: Entrants must (i) comply with the Entry Criteria, (ii) telephone the prize draw hotline on the number provided and follow the instructions given, and (iii) provide all information requested. If using a telephone which is not your own, please remember to get the owner’s permission before entering. Calls will be charged at your operator’s standard rate.

For Entry by Email: Entrants must (i) comply with the Entry Criteria, (ii) email your name and contact details in a SMS message (together with any answer to any questions, where applicable) to the email address provided.

For Entry via an Online Entry Form on a Website: Entrants must (i) comply with the Entry Criteria, (ii) complete the online entry form and submit it in accordance with the instructions provided on the form.

Unless otherwise stated in the Special Rules, there is a limit of one entry per person per day. No entries can be returned.

5.    PRIZES

Each prize will comprise either a pair of tickets or a set of four family tickets, as stipulated in the Special Rules.

Each set of family tickets allows entry for four people, although there can be a maximum of only two adults over the age of 18.

Further details of the prizes and copies of the terms and conditions of prize providers (if any) are available by sending a stamped SAE marking your envelope “Prize Details” to be received during the 6 weeks’ period after the closing date for receipt of entries to the Promoter at the Promotion Address stated in the Special Rules.

In the event that the Promoter wishes to increase the prize pool it may (but shall not be obliged to) do so.

6.    PRIZE DRAW

All valid entries received which have fully complied with any conditions set out in the Special Rules (including correctly answering any questions where applicable) will be collected together for a draw or draws as set out in the Special Rules. The prizes will be allocated to valid entries in the order drawn. The draw(s) will be carried out at random. In the event that any winning entry later proves to be invalid or adjudged void then the Promoter may (but shall not be obliged to) re-award the relevant prize as it sees fit.

The Promoter reserves the right to bar any entry which the Promoter or McDonald’s believes to have been made by to a person who the Promoter or McDonald’s believes in its sole discretion has not, or may not have, complied with any of these Rules.

Unsuccessful entrants will not be contacted, so if you have not been contacted within 24 hours of the draw, you are unlikely to have won.

7.    PRIZE CONDITIONS AND CLAIMS

Prize Conditions: If any winner is under 18, the winner’s parent or legal guardian must claim the tickets in place of the winner and the tickets will be issued in the name of the winner and that parent or legal guardian.

Prizes are also subject to the terms and conditions of each of the relevant sporting bodies and the venue at which the match(es) relating to the prize is being staged.

Prizes are non-transferable; the winner (or the winner’s parent or legal guardian accompanying the winner if under 18) must use the tickets with the companion(s) whose details have been provided to the Promoter in accordance with the claims process below, failing which the prize will become invalid for all purposes.

Unless otherwise set out in the Special Rules, the prize consists only of tickets - winners are solely responsible for organising at their own cost all necessary travel (and obtaining requisite Passports, Visas and other travel documentation), accommodation, subsistence, insurance and other necessary or desirable elements of the trip needed to enjoy the prize.

The details of each winner and winner’s companion may be submitted to the National Criminal Intelligence Service to be searched and anyone with a Football Banning Order (or other conviction considered by the Promoter to be inappropriate for the award of Tickets) may be deemed ineligible for this Promotion at the Promoter’s or McDonald’s discretion without requirement for the Promoter to serve notice and all prizes (whether or not already awarded) and prize-claims of the winner may be declared invalid and deemed void from the outset for that winner and the winner’s companion(s).

All prizes are subject to change in specification and the Promoter reserves the right to change from those advertised in the event that supervening circumstances make this necessary.

Prizes may not be exchanged for any cash or other alternative are not transferable, divisible, permitted to be sold or resold and are not for use in conjunction with any other promotion or offer.  Prizes cannot be replaced or refunded in the event of loss or theft.    Prize winners and their companions are required to carry proof of identity (with valid photograph and signature) when entering a stadium and are required to comply with all applicable safety and security regulations of the stadium. Any person in violation of the applicable ticketing terms and conditions will be refused entry to the stadium or may be expelled from the stadium with no right of refund.

All advertisements depicting the prizes and their accompanying descriptions are illustrative rather than definitive. Any advertisement of the cash value of the prize-pool represents the Promoter’s best estimate of the minimum aggregate retail-price of all prizes which are available to win; it does not thereby imply that any prize will be awarded in the absence of a corresponding valid claim. Reproduction of any prize imagery does not thereby imply any endorsement or association by the producer of that prize nor by the owner of any brand associated with that prize.

All un-awarded or unclaimed prizes will lapse if not the subject of valid claims and the award of which has been completed within the time limits as prescribed by the Rules. Any prizes which are the subject of an invalid or lapsed claim may be re-awarded by the promoter but without obligation to do so.  

8.    PRIZE CLAIMS-PROCESS

The redemption centre will attempt to contact the prize winners in the manner and within the time period specified in the Special Rules. If the redemption centre receives no answer the redemption centre may (but shall not be obliged to) leave details of a contact number for the winner to phone. Whilst the redemption centre will make one more attempt to contact the winner if unsuccessful on the first attempt, following the second attempt the Promoter shall not be obliged to make any further attempt to make contact.

Each winner must supply at the time of first contact with the redemption centre, the full name and residential address and postcode of the winner and the name of the winner’s companion.

Failure to comply with any aspect of the claims-process or within any of the times stipulated shall mean that the winner’s claim will lapse and become invalid and the prize may be re-awarded (but without obligation upon the Promoter to do so).    

Once the claims process has been satisfactorily completed the prize will be dispatched by special delivery post to the address provided by the winner on claiming. McDonald’s is not responsible for any delays or losses in the post.

9.    RESPONSIBILITY

To the fullest extent permitted by applicable law (but not otherwise) the Promoter, McDonald’s and their agents assume no responsibility and are not liable for:- (i) the accuracy or otherwise of the prize description or illustration, (ii) (where applicable) the non-availability, loss, late receipt or damage of any text, prize -claim, prize or notification or other communication and whether by reason of mobile-telephone network-operator error or other problem, failed or corrupted transmission, handset failure (including full or unserviceable inbox) or otherwise, (iii) (other than those warranties or conditions implied by statute and which cannot be excluded) any representation, warranty, condition or guarantee in respect of a prize (iv) (where applicable) any person whose mobile phone is used to text-in an entry without the owner’s permission, or (v) any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a prize, (save to the extent that the Promoter has expressly and specifically accepted responsibility in the Rules for the same).

All prizes remain the property of the suppliers, pending delivery to winners and the Promoter is not responsible for the supply of, and does not own, any prizes provided by other suppliers nor acts as their agent in relation to the delivery to winners of prizes supplied by other suppliers.
 
10.    THE PROMOTER’S RIGHTS

The Promoter may (i) extend any time limit or waive any of the Rules where a person might otherwise have been disqualified (without obliging the Promoter to relax the Rules on any further occasion for that entrant or at all for any other person), (ii) terminate, extend or suspend the Promotion at any time where this is necessary or desirable due to supervening circumstances beyond the Promoter’s control (iii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize to the extent divisible).  The Promoter’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules shall be final and binding.

11.         PRIVACY POLICY

In administering this Promotion, the Promoter or McDonald’s may collect personal information from you and, unless it has first obtained your consent, the Promoter and/or McDonald’s (i) will not collect more of your personal information than needed for the purpose of administering and analysing this Promotion (including carrying out security checks as stated), (ii) will only use your personal information for that purpose which may include transferring your personal information to its associates and to an applicable sporting body(ies) for the purposes of security and monitoring of holders of tickets, and (iii) will not transfer your personal information outside the European Economic Area unless it is permitted to do so under the Data Protection Act 1998.  As it is impracticable for the Promoter to verify the age of those who enter a promotion SMS, email or telephone, the Promoter urges parents to regularly monitor and supervise their children’s mobile phone/computer/telephone activities.

Any enquiries about your personal information should be submitted in writing and sent by pre-paid post to the Promoter at the address set out in the Special Rules marking your envelope “Data Protection Request”. Selected prize providers (depending upon the nature of the prize and whether in addition to or in place of your providing personal data to the Promoter and/or McDonald’s) may require you to provide to the prize provider personal data in connection with claiming a prize and you should satisfy yourself with the privacy policy of that prize provider, as neither the Promoter nor McDonald’s can accept any responsibility for this.

12.         GENERAL

As well as details of names and counties, you agree that, should you be a winner of any prize, then the Promoter may publicise statements made by or attributed to you relating to the Promoter or this or any other promotion or offer together with your likeness and background, unless otherwise requested.

The Promoter and/or the prize providers may require such information (in addition to the information required to be given on prize claims) as they consider necessary or desirable for the purposes of verifying any claim and a claimant’s compliance with the Rules and any prize may be withheld unless and until the Promoter and any prize provider is satisfied with the verification. Should the Promoter determine based on the evidence in its possession at any given time that an entrant is in breach of the Rules, then the Promoter may adjudge (in its sole discretion) that such entrant is ineligible to take part in this Promotion and every other promotion or offer of the Promoter and every Prize, entry and/or claim by that entrant then in process and still to be made shall be deemed invalid and void from the outset.

A list of the names and counties of prize winners or a copy of the Rules may be obtained by sending a signed hand-written request specifying your requirements along with a stamped addressed envelope to the Promotion Address specified in the Special Rules.

Entry to the Promotion amounts to acceptance of the Rules and to their interpretation under English law and by the English courts. All age limits shall be deemed to be actual age as at the time of acceptance of the Rules, unless expressly stated otherwise in these Rules.

Nothing in the Rules shall affect your statutory rights.  The Promoter may (in its sole discretion) decline to enter into any correspondence save as otherwise stated in these Rules.
